DMCA Policy
I respect copyright and expect Course-Loom users to do the same. Consistent with the Digital Millennium Copyright Act (“DMCA”), including 17 U.S.C. § 512(c), I respond to valid notices alleging that content on Course-Loom infringes copyright.
Copyright Notices
To request removal of allegedly infringing content, send me a written notice containing:
- Your physical or electronic signature.
- Identification of the copyrighted work, or a representative list if multiple works are involved.
- Identification and location of the allegedly infringing content.
- Your contact information.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the notice is accurate and that you are authorized to act for the copyright owner.
I may provide the notice to the person who posted the content. Incomplete or inaccurate notices may not be effective.
Counter-Notices and Restoration
If your content was removed or disabled because of a DMCA notice and you believe that happened through mistake or misidentification, you may send a counter-notice containing:
- Your physical or electronic signature.
- Identification of the removed content and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the content was removed or disabled through mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the appropriate United States federal district court and accepting service of process from the person who submitted the original notice or that person’s agent.
I may send the counter-notice to the original claimant. Unless the claimant informs me that they have filed a court action seeking to restrain the alleged infringement, I may restore the content as permitted by the DMCA, generally no sooner than 10 and no later than 14 business days after forwarding the counter-notice.
Repeat Infringers
In appropriate circumstances, I may suspend or terminate users who repeatedly infringe copyright. I may also remove or restrict access to content when I reasonably believe doing so is necessary to protect copyright holders or CourseLoom.
Designated Agent
DMCA notices and counter-notices should be sent to CourseLoom’s designated copyright agent using the contact information published for CourseLoom.
CourseLoom’s designated-agent registration with the U.S. Copyright Office is pending. This policy does not replace that registration, which must be completed and kept current for CourseLoom to seek DMCA safe-harbor protection.
